Session Title: Understanding Employer Rights
Michael Rubin is a shareholder and OSHA defense attorney with Ogletree Deakins, one of the nation’s leading labor and employment law firms. With over 20 years of experience, Michael focuses his practice exclusively on OSHA matters across the United States, representing employers in construction, manufacturing, energy, healthcare, transportation, and other high-risk industries.
He has guided clients through every stage of the OSHA process—from inspections and citations to litigation—successfully defending numerous employers in both federal and state-plan jurisdictions. Michael has handled OSHA cases in more than 30 states and achieved multiple favorable trial outcomes, including vacated citations and withdrawn enforcement actions in fatality investigations.
In addition to his legal practice, Michael is a Certified Safety Professional (CSP) and Construction Health and Safety Technician (CHST) through the Board of Certified Safety Professionals. He frequently presents to national industry organizations such as the Associated General Contractors (AGC), Associated Builders and Contractors (ABC), EHS Today, and the American Society of Safety Professionals (ASSP).
Michael’s presentation, “Employer Rights,” will provide attendees with a practical understanding of employer obligations and defenses under the Occupational Safety and Health Act. Topics will include navigating the OSHA inspection process, protecting company interests during interviews and document requests, and strategies for managing citations, settlements, and litigation. Participants will gain valuable insight into how to effectively assert their rights while maintaining a strong culture of compliance and safety excellence.

From I-110: Exit I-110 at Government Street. Take Government Street west towards the river and turn left onto St. Phillip Street. Continue on St. Phillip to traffic light at South Boulevard. Turn right onto South Boulevard. Cross over railroad track and street becomes River Road curving left under the Mississippi River Bridge. Continue on River Road. As you approach the Center for Coastal and Deltaic Solutions, the parking lot will be on the left side of River Road and the building will be on the right side of River Road.
From I-10: Exit I-10E at Highland Rd/Nicholson Dr. Follow the exit ramp onto Oklahoma St. Take Oklahoma St to River Rd. Turn right on River Rd. As you approach the Center for Coastal and Deltaic Solutions, the building will be on the left side of River Road and the parking lot will be on the right side of River Road.
